Home Staging

Terms and Conditions for Home Staging Services

This agreement is made between **Interiors by Style** ABN 28127635652 (hereafter referred to as “Interiors by Style”) of Melbourne, Victoria, and the person or persons named in Item 1 of Reference Schedule of this Contract (hereafter referred to as “The Client”)

BACKGROUND

I. I acknowledge as "The Client" that I am the legal owner and/or representative of the legal owner of the property.

II. The Client wishes to engage the services of Interiors by Style on the terms and conditions stated in this contract.

III. The Client has accepted a home staging and styling quotation provided by Interiors by Style.

IV. The objective of entering this home staging and styling contract is to maximise the market value of the Client’s property.

V. The Client acknowledges that they are not entering into this contract relying on any written or verbal promise, representation, or warranty made by Interiors by Style unless such promise, representation, or warranty is made an express term or condition of this contract.

VI. Any special conditions sought by the Client and agreed to by Interiors by Style that are not part of the standard terms and conditions of this contract will only become valid and enforceable if separately written up and stapled to this contract, with the heading “Special Conditions to the Contract between Interiors by Style and [Name of Client] dated [Date of Contract]” and signed by both parties.

THE PARTIES AGREE AS FOLLOWS:

1. Services Provided

The Client has accepted their quotation and agrees that Interiors by Style will conduct the following work:

- (a) Consult with the Client

- (b) Select, install and place furniture and goods in the property, including hanging art on the walls, using permanent fixings

- (c) Arrange collection and delivery of furniture and goods

- (d) If requested, organise tradesmen to undertake work as agreed with the Client

- (e) Perform other work incidental to the provision of property styling services for the Client, in accordance with the package chosen by the Client.

2. Authorization

The Client authorises Interiors by Style, its employees, contractors, agents, and servants to:

- (a) Enter the property at all reasonable times to undertake the work

- (b) Install and place furniture and goods in and on the property

- (c) Install permanent fixings (hooks/screws) to hang art and mirrors

- (d) Move or remove existing furniture and goods on the property

- (e) Arrange for repairs to the property or anything on the property as agreed by the Client

- (f) Perform other necessary tasks to undertake the work.

3. Client Responsibilities

The Client agrees:

- (a) The premises will remain secured during the property styling contract and any extended periods

- (b) The environment will remain smoke-free and free of any emissions/smells that may damage the property styling furniture and goods

- (c) Unless agreed in writing, the styled property will not be occupied (and additional insurances will be included)

- (d) No pets will be present at the property unless otherwise agreed in writing

- (e) If styling is required beyond the allocated period, additional fees will apply, as outlined in the quotation

- (f) The Client acknowledges that the styling stock may be allocated to other contracts, and extensions cannot always be guaranteed.

4. Total Cost

The Total Cost includes:

- (a) The cost of work undertaken by Interiors by Style in accordance with the accepted quotation

- (b) Any costs related to processing transactions, with prior notification to the Client

- (c) Additional fees for repairs, replacements, or restoration of styling stock damaged by pets, smoke, or any other action, including theft

- (d) Any requested changes or additional work outside the original contract will be quoted separately

- (e) Extension fees, if applicable, will be invoiced as per Item 4.

5. Deposit

A deposit may be requested to secure the Client’s scheduled staging date.

6. Tax Invoices

- (a) Interiors by Style shall issue the Client with a tax invoice for the total cost.

- (b) Invoices are payable a minimum of 7 full working days before the scheduled staging day, unless agreed otherwise.

- (c) Subsequent invoices for new charges must be paid before service delivery.

- (d) For contract extensions, payment must be received at least 2 full working days before the extension.

7. Cancellation and Deferral of Styling

- (a) A 80% refund is provided for cancellations at least seven (7) full working days prior to install.

- (b) A 50% refund is provided for cancellations within three (3) full working days prior to install.

- (c) No refund is given for cancellations on the day prior to or on the day of the scheduled installation.

- (d) Changes of dates with at least seven (7) full working days’ notice may be accommodated without penalty.

- (e) A $750 fee will apply for deferrals made within three (3) full working days prior to install.

8. Contractors

The Client will directly enter into contracts with any suppliers or tradesmen. Interiors by Style is not liable for any losses or damages caused by contractors.

9. Warranty and Indemnity

- (a) The Client acknowledges that the advice provided by Interiors by Style is cosmetic and aesthetic in nature.

- (b) The Client must seek their own professional advice for structural work.

- (c) Interiors by Style does not guarantee the property will sell quicker or for a higher price as a result of styling.

10. Insurance

- (a) Interiors by Style agrees to insure styling stock while in transit and once placed at the property, excluding flood damage.

- (b) The Client is liable for the equivalent excess amount of $500.

11. Sun Protection Cover

- (a) Interiors by Style will provide Sun Protection Sheets where applicable.

- (b) The Client is responsible for ensuring these sheets remain on furniture when not in use.

12. Intellectual Property

- (a) Interiors by Style retains the rights to all photographs and recordings of the property and work. These may be used for promotional or training purposes.

- (b) The Client grants Interiors by Style a license to use images produced by others for the same purposes.

13. Frustration of Contract

- (a) If Interiors by Style is unable to fulfill obligations due to circumstances beyond its control, such as an act of God or civil disorder, the contract will be suspended for a reasonable time.
